Measures in response to the arrival of displaced people fleeing the war in Ukraine

The European Council on Refugees and Exiles (ECRE) published an updated, non-exhaustive information sheet giving an overview of the implementation of the Temporary Protection Directive (TPD) - and national equivalents - in 34 countries in response to the displacement of people from Ukraine across Europe.

The list covers key developments until January 2023, examining in particular:

  • the scope of the TPD;
  • reception, free movement and access to rights;
  • extensions of temporary protection status;
  • updated rules on re-entry;
  • access to (and conditions of) accommodation;
  • access to social support.

According to the sheet, approaches to the extension of temporary protection status for those displaced from Ukraine vary: Austria, Finland, Norway, and Slovakia prolonged it automatically, while France requires that individuals apply for extension in-person and Sweden and the Czech Republic have made provisions for application online. Other countries, such as Latvia, initially issued residence permits valid for longer than a year, while Poland only extended temporary protection status until August 2023.

In the Netherlands, the decision was taken that temporary protection status would not be extended for third-country nationals (TCNs) who had been living in Ukraine on a temporary residence permit. Those still in the Netherlands after 3 March 2023 will therefore be required to either return to their country of origin, or to apply afresh for international protection in the Netherlands.

As far as accommodation is concerned, both Poland and the Czech Republic introduced amendments limiting the period of free residence in accommodation centres and introducing payment for stays of over 120 and 150 days respectively.
